How are you accumulating Interest? Is your DOD correct?
In reviewing the legal principles demonstrated by John Bedard and Rozanne Anderson in their recent 'Important Dates' presentation at ACA & CAC. They make clear that the Date of Delinquency of an account cannot be less than 30 days from the Date of Service. Appling this FCRA principle to the mechanics of our available options for calculating interest accumulation leads us to need the option of calculating interest from the Date of Delinquency. Many state interest laws, such as mine, are triggered at the date of a breach, not the date of transaction or service.
I have made a revision suggestion to add a system definition flag to calculate interest based on the date of delinquency, rather than the two existing options of Date Of Service vs Date Of Referral.
I would urge anyone to ask their own council for guidance on this before adoption. As I certainly have.
